It’s best to seek the help of a nurse attorney when facing different complaints and allegations. However, some nurses tend to face these results instead without thinking that nurse attorneys are always reliable for matters such as these.

On or about September 12, 2016, through November 2, 2017 the LVN violated the professional boundaries of the nurse/patient relationship in that she visits the patient during non-business hours and continued communication with the patient through text messages, telephone calls and social media.

In addition, the LVN admitted that she stayed overnight at the patient’s residential room. Her conduct could have resulted in confusion between the needs of the nurse and those of the patient. In addition, it could also cause delayed distress for the patient and may not be recognized and harmful consequences may occur.

Aside from the case of violating the nurse-patient relationship, the LVN also committed another misconduct when she failed to complete documentation for nursing home health visits for several patients.  Her conduct resulted in an inaccurate medical record and was likely to injure the patient in that subsequent caregivers would not have complete information on which to base their care decisions.

The Texas Board of Nursing sent a letter to the LVN regarding the issue so then she can have the chance to defend herself. However, she was not able to provide a good defense for herself. Therefore, the Board placed her LVN license to a disciplinary action instead.

Any RN or LVN should never exceed the nurse-patient relationship in and out of work as it may affect their performance, which may lead to further issues to the patients they are taking care of. Additionally, if you ever undergo cases such as this, it’s best to seek the assistance of a good nurse attorney as it could make the case better in your favor.
