An experienced nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead toward disciplinary action. On or about February 1, 2007 through February 12, 2007, while employed as a Licensed Vocational Nurse in Harlingen, the LVN admitted that she engaged in the intemperate use of Dilaudid that she misappropriated from the facility and the patients thereof.

Possession of Dilaudid, without a valid prescription, is prohibited by Chapter 481 of the Texas Health and Safety Code (Controlled Substances Act). The use of Dilaudid by a Vocational Nurse, while subject to call or duty, could impair the nurse’s ability to recognize subtle signs, symptoms or changes in the patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

Because of this, a complaint was filed against the LVN.  The Texas Board of Nursing has full jurisdiction over all cases regarding errors committed by an RN or LVN.

The following incident and defense against the case caused the Texas Board of Nursing to place the LVN and her license into disciplinary proceedings. She would have sought assistance from a good nurse attorney to provide clarifications towards the case.
