Accusations are stressful issues for an RN or LVN, except when Texas BON attorneys assist you against the case. The Texas Board of Nurses is responsible for all hearings against RNs and LVNs undergoing a case that may revoke suspend or only discipline their license. On or about May 21, 2018, through May 22, 2018, while employed as an LVN at a nursing facility in Houston, Texas, LVN was accused of the following:

  1. Lacked fitness to practice vocational nursing, in that she was observed to be exhibiting impaired behavior while duty; including but not limited to shaking, sweating, repeatedly spilling medication, and being observed with orange-colored medication residue on her mouth. LVN’s conduct could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger.
  2. Misappropriated Nucynta 100mg tablets, a Schedule II narcotic, belonging to a patient, or failed to take the precautions to prevent such misappropriation. LVN’s conduct was likely 10 defraud the patient of the cost of the medication.

 

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A)&(1)(B) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4),(6)(G),(8)&(11)(B).

The evidence against the LVN was strong. At the same time, she was not able to properly defend her case in court. As a result, her nursing license was revoked. She was no longer allowed to practice the nursing profession in the State of Texas.
