Any nurse who faces criminal cases or any serious offenses that they wish to resolve should hire a nurse attorney to strengthen their defense. Professionals help can provide a better form of defense against the Texas Board of Nursing as an RN or LVN faces an accusation of any criminal charge they committed or they never committed. This is just one of the many cases the LVN from El Paso should have known had she only hired a nurse attorney to help her.

An RN from Garland, Texas was arrested by the Police and subsequently charged with DRIVING WHILE INTOXICATED, a class B misdemeanor offense that the RN committed on November 19, 2010. Then on or about December 9, 2010, it was dismissed for the reason: Taken into consideration.
But on or about January 22, 2011, the RN was arrested again by the Police for the same offense. The RN entered a plea but was convicted of DRIVING WHILE INTOXICATED. As a result of the conviction, the RN was sentenced to confinement in jail for a period of six (6) months; however, imposition of the sentence of confinement was suspended and the RN was placed on probation for a period of eighteen (18) months.

As a response to the incident, in which the RN committed the offense, the RN states that she regrets that she was arrested and charged with two DWI’s.

The RN’s conduct was reportable under the provisions of Section 301.401-301.419, Texas Occupations Code. The Texas Board of Nursing finds that there exists a serious risk to public health and safety as a result of impaired nursing care due to intemperate use of alcohol, controlled substances, or chemical dependency. The RN’s conduct resulted from or was significantly influenced by the RN’s substance use disorder. The RN’s compliance with the terms of a Board approved peer assistance program should be sufficient to protect patients and the public.

As a result of the RN’s misconduct, the RN has to face disciplinary action from the Board. The Texas Board of Nursing gave the RN the chance to defend herself. However, she was not able to provide a good defense for herself like hiring the right nurse attorney.
