The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RNs in Texas. Her  conduct  was  likely  to  deceive  the  pharmacy,  and possession  of Oxcarbazepine  through  use of a fraudulent  telephonically  communicated prescription  is prohibited by Chapter 483 (Dangerous Drugs Act) of the Texas Health and Safety Code.

As a defense to the case, the RN states that her daughter did not have medical insurance, and she made the choice to get her daughter the medicine she needed. 

However, the Texas Board of Nursing finds that her conduct violates the Texas Occupations Code. As a result, her license was disciplined and suspended.
