The Texas Board of Nursing (BON) is the government agency that has jurisdiction to hear and decide administrative cases involving RN and LVN in Texas. It is also the agency that is responsible for overseeing the practice of professional nursing all over the state of Texas. Any RN or LVN who is guilty of violating state laws and issues from the Texas Board of Nursing (BON) may be subjected to penalties or fines if not properly defended by a nurse attorney. As a matter of fact, the RN license and LVN license can even be suspended or revoked.

A perfect example of this incident happened to an RN in 2020. At the time of the initial incident, she was employed as an RN in a skilled nursing facility in Bryan, Texas, and had been in that position for almost three (3) years.

On or about May l , 2020, and May 3, 2020, while employed as an RN in a skilled nursing facility in Bryan, Texas, RN misappropriated, or failed to take precautions to prevent the misappropriation of, Fentanyl and Clonazepam from the facility and patients thereof. RN’s conduct was likely to defraud the facility and patients of the cost of the medications.

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(4),(6)(G),(8),(10)(E)&(11)(B).

On or about June 3, 2020, while employed as an RN in a skilled nursing facility in Bryan, Texas, RN removed a Clonazepam 0.5mg tablet from the medication dispensing system for Patient B, but failed to document, or accurately and completely document, the administration of the Clonazepam in the patient’s electronic health record. RN’s conduct was likely to injure the patient in that subsequent care givers would rely on her documentation to further medicate the patient, which could result in an overdose. Additionally, RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

The above action constitutes grounds for disciplinary action in accordance with Section 301.452(b)(10)&(13), Texas Occupations Code, and is a violation of 22 TEX. ADMIN. CODE §217.11(1)(A),(1)(B),(1)(C),&(1)(D) and 22 TEX. ADMIN. CODE §217.12(1)(A),(1)(B),(1)(C),(4)&(11)(B).

However, the lack of evidence and expert nurse attorney to defend her led to the Texas Board of Nursing’s decision to revoke her license.
