The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations may be subjected to a disciplinary case if not properly defended by a nurse attorney.
Two of the examples where a client failed to hire the right nurse attorney will be discussed in this case.
The first case happened on or about January 28, 2017. While employed as an LVN in a nursing home in Athens, the LVN documented and submitted nurse visit notes for eight (8) patients but failed to visit the patients. Her conduct was likely to injure the patients in that subsequent caregivers would rely on her documentation to further administer care to the patient.
The LVN not only admits to her mistake when summoned by the Texas Board of Nursing. She also failed to hire a nurse attorney to handle her case. The result is a discipline suspension of her license.
The other case happened on or about November 2, 2017 to an LVN in Bedford. During the said time, the LVN disclosed the patient’s confidential health information to the patient’s employer without authorization. The LVN faxed a portion of the patient’s medical records to the patient’s employer. Further, the LVN admitted to her Nurse Manager and the Privacy Officer that she inadvertently faxed the patient’s medical records to the employer.

The LVN failed to properly present and defend her case against the court. She was disciplined warning to suspension of her LVN license by violating Texas Board of Nursing regulation.
