On or about October 16, 2019, an LVN was required to successfully complete the Texas Peer Assistance Program for Nurses (TPAPN) through an Order of the Board. A copy of October 16, 2019, Order is attached and incorporated herein by reference as part of this Agreed Order. 

An incident happened on or around the 26th of May, 2021, the LVN became non-compliant with the Agreed Order for Peer Assistance Program issued to him by the Texas Board of Nursing on October 16, 2019. Noncompliance is the result of LVN’s failure to comply with all requirements of the Texas Peer Assistance Program for Nurses (TPAPN) participation agreement, in that said LVN: tested positive on one (1) drug screen, failed to check into the program’s drug-testing administration system six (6) times and missed one (1) drug screen, failed to submit eleven (11) Meeting Attendance Logs and seven (7) Participant Therapist Reports and failed to attend Mutual Support Groups nine (9) times. Section I, Stipulation D of the Agreed Order for Peer Assistance Program dated October 16, 2019, states: 

“(D) RESPONDENT SHALL comply with all requirements of the TPAPN participation agreement during its term…” 

On May 26th, 2021, or shortly thereafter, the LVN was dismissed from TPAPN and referred back to the Board. 

As a result of the incident that occurred, the LVN states that he was unable to continue working after he became sick in 2020, and therefore, he struggled to afford his TPAPN obligations during that time. The said LVN relates he was in the process of uploading documents to TPAPN when his access to TPAPN’s system was deactivated and he was dismissed from the program. 

The RN was given the chance to defend against his case and present herself to the Board. However, despite her explanation, the Texas Board of Nursing placed his under disciplinary action but without any suspension whatsoever.
