Furthermore, the LVN forged the signature of the patient’s mother when she failed to obtain the signature during her shift. Subsequently, on December 6, 2019, she documented a complete shift Skilled Progress Note when she was not scheduled to work that day. Her conduct resulted in an inaccurate, incomplete medical record, and was likely to injure the patient in that subsequent caregivers would rely on her documentation in order to provide further patient care.

During the hearing, the LVN admits to the allegations but asserts that she did not do it maliciously or to commit fraud. She admits to being tired at the end of her shift but had to go home, shower, and back for her trip the next morning. On the way to the airport, the LVN states that she was going to drop off her notes in the dropbox and realized that she had the complete note instead of leaving the carbon copy in the patient’s home. She also realized that she had not had the mother sign her timesheet. “Foolishly I signed the note, but the time in and placed the note in the dropbox.
