The Texas Board of Nursing (BON) has the jurisdiction to hear and decide cases involving the practice of professional nursing in Texas. Any RN or LVN found guilty for violating the state laws and regulations as well as charged with the case may be subjected to a disciplinary case if not properly defended by a Killeen nurse attorney.

On or about July 27, 2019, through September 13, 2019, while employed as a Licensed Vocational Nurse in Killeen, Texas, the LVN failed to apply a ventilator to a patient, as ordered by a physician. In addition, she falsely documented that she applied the ventilator to the patient. Subsequently, the LVN admitted to facility staff to falsely documenting the treatment. Her conduct also created an inaccurate medical record and failure to administer the ventilator as ordered by the physician could have resulted in non-efficacious treatment.

Her conduct was likely to injure the resident in that failure to administer the ventilator as ordered by a physician could have resulted in non-efficacious treatment.

During the hearing, the LVN admits to failing to apply the ventilator as ordered, citing poor training and inability to get help from the facility or the patient’s caregivers. She neither admits nor denies falsely documenting the treatment.

Because of the lack of an effective nurse attorney to help her defend her case, the LVN was disciplined for violating Texas Board of Nursing regulations.
