In this time of the pandemic, the real heroes are our brave nurses. However, they are aware that if they are not thorough while doing their job, they may face the possibility of being called to come in on a day off to correct charting, or face the fear that if they miss something, they could face disciplinary action. On or about February 15, 2011, while seeking employment in a hospital in League City, the RN engaged in the intemperate and unlawful use of Cocaine in that she submitted a specimen for a pre-employment drug screen that resulted positive for Cocaine. Possession of Cocaine is prohibited by Chapter 481 (Controlled Substances Act) of the Texas Health & Safety Code. The use of Cocaine by a Licensed Vocational Nurse, while subject to call or duty could impair the nurse’s ability to recognize subtle signs, symptoms, or changes in the patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

On or about April 15, 2013, while participating in the Texas Peer Assistance Program for Nurses’ (TPAPN) Extended Evaluation Program (EEP), the RN engaged in the intemperate use of Cocaine in that she submitted a specimen that resulted positive for Cocaine. As a result of her positive screen for Cocaine, the RN’s EEP case was closed and converted to a TPAPN participation agreement on April 25, 2013. Possession of Cocaine is prohibited by Chapter 481 (Controlled Substances Act) of the Texas Health & Safety Code. The use of Cocaine by a Licensed Vocational Nurse, while subject to call or duty could impair the nurse’s ability to recognize subtle signs, symptoms, or changes in the patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

In response to the incident, the RN states that she does not recall the circumstances surrounding those drug tests. In reference to the drug screen of November 6, 2013, the RN states that she had wine while out with friends after the discovery of a life-altering situation. In reference to the drug screen of January 17, 2014, she states that she asked a friend for a cigarette, which, unbeknownst to her, was laced with Cocaine, the RN states she takes full responsibility for her mistakes and is fully regretful for these situations, which have taken a toll on her career.

Notwithstanding the new norm created by this pandemic, it is not a hidden secret that the nursing community is also facing some long-understood truths, that is nurses are underpaid, undervalued, and sometimes treated as expendable. But this doesn’t remove the nurse’s will to help treat their patients the best they can.

However, because of the exhaustion, this pandemic is giving to the nursing community, some nurses may accidentally fail to do their work nicely. Because of this, they may face a disciplinary hearing by the Texas Board of Nursing.
