She states the step of checking for a signed consent is part of following the hospital established guidelines for HIPAA (The Health Insurance Portability and Accountability Act) rules, as well as state and federal regulations.

The RN further states during her tenure, as part of the leadership team, she did not get involved in a patient case without a request for assistance so she is “perplexed” as to how she could have called the patient’s employer to release information without her consent and the information is not even related to her treatment.

 

Because of this, the Texas Board of Nursing suspended and disciplined the RN.
