One of the most common disciplinary issues among nurses in Texas is illegal drug use. This is the main reason why a nurse license attorney in San Antonio is required to engage in the nurse license defense before the Texas Board of Nursing.

This is what happened to a certain RN in San Antonio, Texas in March 2019. During the time of the initial incident, the RN was employed as head nurse and had been in the position for more than a year.

The first incident happened when the RN engaged in the intemperate use of a drug called Demerol. Possession of this drug is prohibited by Chapter 481 of the Texas Health & Safety Code (Controlled Substances Act). The use of Demerol by a RN while on duty could impair the nurse’s ability to recognize symptoms or changes in the patient’s condition, and could impair the nurse’s ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

The second incident happened when the RN misappropriated the drug Demerol belonging to the facility. The RN admitted to the misappropriation and the facility turned the case over to the Austin Police. On March 25, 2018, the RN was arrested for the offense of Fraud to Obtain a Controlled Substance which is a second degree felony.

The Texas Board of Nursing gave the RN the chance to defend herself. However, she was not able to provide a good defense for herself, especially when the drug screening results were brought up to her. Therefore, the Board placed her RN license to a disciplinary action instead.
