This is the story of an RN who was disciplined for accusations of negligence.
On or about January 11, 2004, a patient had an operation to remove both the right and left fallopian tubes, in addition to the right ovary. The RN was the circulating nurse during the procedure on the patient and was the person responsible for completing a final check to ensure the sponge count is order is correct.
During that time, the RN performed the initial sponge count and the count was reported as correct, and at the conclusion of the procedure, that she documented that all the sponges had been accounted for.
On or about January 15, 2005, an x-ray revealed the presence of a retained sponge in the patient.
On or about January 16, 2005, a physician performed surgery to remove the retained sponge.
The law provides that unprofessional conduct, as defined by Board rule, constitutes grounds for disciplinary action by the Board of Nursing.
The RN engaged in unprofessional conduct and was negligent when she failed to provide the correct sponge count during the surgical procedure performed on the patient.
The Texas Board of Nursing then subjected the RN and her license into disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the RN hired one.
