During the hearing, the LVN states that as she was preparing the patient to be moved to the stretcher after the surgery, she discovered that she had accidentally nicked the external surface of the patient’s thigh with scissors during the undraping.

She explains that the cut was superficial. She indicates that after she cleaned the area, she applied skin glue, and asked the circulator to make a note on the operative record. She explains that the physician didn’t return to the OR, and she intended to find him and inform him what had happened, but unintentionally forgot.

However, the Texas Board of Nursing disciplined her license because they think that her conduct was likely to injure the patient from lack of appropriate nursing and medical care.

The Texas Board of Nursing has full jurisdiction over all cases that may affect the LVN license.
