Sleeping while at work is a serious case, which is why a nurse attorney is needed if you get accused of this kind of scenario. Her conduct could have affected her ability to recognize subtle signs, symptoms or changes in patient’s condition, and could have affected her ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patient in potential danger.

Because of this,, she was summoned by the Texas Board of Nursing to hear and defend her side of the story. During the defense, the LVN states she has never fallen asleep while on duty.

The RN further states on the night in question, she sat at a desk, with her head propped on her fist, and documented the care she provided to the patient. She states she communicated with the patient’s parents when they entered the patient’s room.

However, she failed to hire an experienced nurse attorney to properly defend her side. This is the reason why the Texas Board of Nursing discipline and suspended her license.

Any RN or LVN should never use any substance in and out of work as it may affect their performance, which may lead to further issues to the patients they are taking care of.
