At the time of the incident, an LVN was employed as a Licensed Vocational Nurse at a hospital in Corpus Christi, Texas, and had been in that position for three (3) months.

On or about December 20, 2020, while employed as a Licensed Vocational Nurse, the LVN signed out Furosemide, Metoprolol, and Potassium to administer to the Patient, but failed to waste the medication after the patient expired. The LVN subsequently took the medication home with her but returned them to the facility after discovering the medications in her residence. The LVN’s conduct left medications unaccounted for, was likely to deceive the facility pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code.

In response, the LVN states she placed the bagged medication in her pocket with the intent to administer them at the bedside when the patient coded and subsequently died. the LVN further states that after the emotional trauma of the code and losing a patient she forgot she still had the medications in her pocket when departing for home two (2) hours after her shift ended and ultimately returned them to her supervisor.

The Texas Board of Nursing then subjected the LVN and her license to disciplinary action. The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
