At the time of the incident, an RN was employed as a Registered Nurse at a hospital facility in Corpus Christi, Texas, and had been in that position for ten (10) years and three (3) months. 

On or about July 2, 2020, while employed as a Registered Nurse, the RN lacked the fitness to practice nursing in that he exhibited signs of impaired behavior while on duty, including, but not limited to hyper, unable to keep still, and being off the unit for an extended period. The RN’s condition could have affected his ability to recognize subtle signs, symptoms, or changes in patient’s conditions, and could have affected his ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger. 

An incident happened on or around the 4th of July, 2020, while employed as a Registered Nurse, the RN lacked the fitness to practice nursing in that he exhibited signs of impaired behavior while on duty, including, but not limited to: twitching, pinpoint pupils, avoiding eye contact, incomplete thoughts, repeatedly sitting down and then quickly standing back up, and entering patient rooms not assigned to him. Furthermore, the RN initially agreed to take a urine drug screen, but subsequently declined and left the facility. The RN’s condition could have affected his ability to recognize subtle signs, symptoms, or changes in patient’s conditions, and could have affected his ability to make rational, accurate, and appropriate assessments, judgments, and decisions regarding patient care, thereby placing the patients in potential danger. 

In response to the incidents that happened, the RN states that he relapsed after five years of sobriety and that some of the behaviors reported were possibly residual from his relapse. The RN relates there were also other physical conditions that could have been the cause of the reported behaviors. On July 4, 2020, the RN indicates he was floated to a new floor he was unfamiliar with, which may have caused him to enter rooms not assigned to him. The RN also asserts that he is normally a hyper personality and believes his presentation may have been due to that. The RN mentioned that a drug screen would have likely returned positive; however, he did not use substances while at work or before work

The case could have resulted in a lesser disciplinary action by the Texas Board of Nursing (BON), only if the RN hired an effective nurse attorney to help her win her case.
