At the time of the incident, an RN was employed as a Registered Nurse at a medical facility in El Paso, Texas, and had been in that position for two (2) months. 

An incident happened on or about July 10, 2019, through August 8, 2019, while employed as a Registered Nurse, an RN withdrew one (1) tablet of Hydrocodone 10/325 for Patient 1, one (1) tablet of Hydrocodone 5/325 for Patient 2, one (1) syringe of Morphine 2mg for Patient 3, and two (2) syringes of Morphine 2mg for Patient 4, but failed to document and/or completely and accurately document the administration of the medications in the patients’ Medication Administration Records and/or nurses’ notes. The RN’s conduct was likely to injure the patients in that subsequent caregivers would rely on his documentation to further medicate the patients which could result in an overdose. Additionally, the activity of the RN placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code. 

It was on or about July 10, 2019, through August 8, 2019, while employed as a Registered Nurse, the said RN withdrew one (1) tablet of Hydrocodone 10/325 for Patient 1 and one (1) tablet of Hydrocodone 5/325 for Patient 2, one (1) syringe of Morphine 2mg for Patient 3, and two (2) syringes of Morphine 2mg for Patient 4 but failed to follow the facility’s policy and procedures for wastage of the unused portions of the medications. The action of the RN left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code. 

On or around July 10th, 2019, through August 8, 2019, while employed as a Registered Nurse, the RN failed to take precautions to prevent the misappropriation of one (1) tablet of Hydrocodone 10/325 for Patient 1, one (1) tablet of Hydrocodone 5/325 for Patient 2, one (1) syringe of Morphine 2mg for Patient 3, and two (2) syringes of Morphine 2mg for Patient 4. The activity of the RN was likely to defraud the facility and patients of the cost of the medications. 

In regards to the incident that happened, According to the RN, he had difficulty learning the computer charting system. The RN mentioned that he thought he entered the medications correctly into the system, but he was told the medications weren’t documented as given.

Because of this, the RN was summoned by the Texas Board of Nursing to hear her side. The said RN denies misappropriating medications. The RN added that he took a urine drug screen, which resulted in a negative. 

However, the lack of an experienced nurse attorney to help her led to the decision of the Texas Board of Nursing to discipline and suspend the RN.
