Being non-compliant with the terms in the Agreed Order could become a big problem and could be a risk to your license. It is why every RNs/LVNs facing disciplinary proceedings should take it seriously and be compliant with every term that is agreed upon to prevent the worst from happening. It is time that you need the help of a nurse attorney when undergoing disciplinary proceedings.

On or about November 12, 2019, an RN from San Marcos, Texas was issued the sanction of Reprimand with Stipulations through an Order of the Board. A copy of the November 12, 2019, order is attached and incorporated herein by reference as part of this Agreed Order.

On or about November 13, 2020, the RN failed to comply with the Agreed Order issued to her on November 12, 2019, by the Texas Board of Nursing. Noncompliance is the result of her failure to comply with Section IV, subsection A, Remedial Education Course(s), of the Agreed Order which states, in pertinent part:

“RESPONDENT SHALL successfully complete . . . within one (l) year of the effective date of this Order . . . A Board-approved course in Texas nursing jurisprudence and ethics that shall be a minimum of six (6) hours in length, …”

On or about November 13, 2020, the RN failed to comply with the Agreed Order issued to her on November 12, 2019, by the Texas Board of Nursing. Noncompliance is the result of her failure to comply with Section IV, subsection B, Remedial Education Course(s), of the Agreed Order which states, in pertinent part:

“RESPONDENT SHALL successfully complete . . . within one (l) year of the effective date of this Order A Board-approved course in medication administration with a didactic portion of not less than six (6) hours and a clinical component of not less than twenty-four (24) hours, …”

On or about November 13, 2020, the RN failed to comply with the Agreed Order issued to her on November 12, 2019, by the Texas Board of Nursing. Noncompliance is the result of her failure to comply with Section IV, subsection C, Remedial Education Course(s), of the Agreed Order which states, in pertinent part:

“RESPONDENT SHALL successfully complete within one (l) year of the effective date of this Order The course ‘ Sharpening Critical Thinking Skills,’ a 3.6 contact hour online program provided by the National Council of State Boards of Nursing (NCSBN) Learning Extension, …”

In response, the RN states she is unable to practice nursing due to medical circumstances, and will not be able to work as a nurse in the future.

However, her lack of an experienced nurse attorney to properly defend and assist her during the disciplinary proceedings led to her voluntarily surrendering her license.
