An experienced nurse attorney has surely helped a lot of RNs and LVNs when it comes to cases that may lead to disciplinary action. Unfortunately, not all nurses were able to hire a nurse attorney as they underwent such cases. 

At the time of the initial incident, an RN was employed as a Registered Nurse at a hospital in Abilene, Texas, and had been in that position for three (3) months. 

It was on or about May 23, 2020, through July 27, 2020, while employed as a Registered Nurse, the RN failed to conduct hourly rounding on several patients as required. The RN exposed the patients to a risk of harm from potential changes in condition going undetected and untreated. 

An accident happened on or about August 24, 2020, and October 17, 2020, while employed as a Registered Nurse, the RN withdrew Ambien 5mg tablet, Tramadol 50mg tablet, and Oxycodone/APAP 5/325mg tablet from the medication dispensing system for those patients, but failed to document and/or accurately and completely document the administration of the medication in the patients’ Medication Administration Record (MAR) and/or Nurses’ Notes. An RN’s conduct was likely to injure the patients, in that subsequent caregivers would rely on his documentation to further medicate the patients, which could result in an overdose. Additionally, the RN’s conduct placed the hospital in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code. 

It occurred on or about August 24, 2020, through November 24, 2020, while employed as a Registered Nurse, an RN withdrew Ambien 5mg tablet, Tramadol 50mg tablet, and Oxycodone/APAP 5/325mg tablet from the medication dispensing system for the patients, but failed to follow the facility’s policy and procedure for wastage of the unused portions of the medications. The RN’s conduct left medications unaccounted for, was likely to deceive the hospital pharmacy, and placed the pharmacy in violation of Chapter 481 (Controlled Substances Act) of the Texas Health and Safety Code. 

A mishap happened on or about August 24, 2020, through November 24, 2020, while employed as a Registered Nurse, the RN misappropriated Ambien 5mg tablet, Tramadol 50mg tablet, and Oxycodone/APAP 5/325mg tablet belonging to the facility and patients thereof, or failed to take precautions to prevent such misappropriation. The RN’s conduct was likely to defraud the facility and patients thereof of the cost of the medications. 

The following incident and defense against the case caused the Texas Board of Nursing to place the RN and her license into disciplinary proceedings. She could have sought assistance from a good nurse attorney to provide clarifications for the case.
