Getting intoxicated by alcohol or drug use while at work is a serious case, which is why a nurse attorney is needed if you get accused of this kind of scenario. On or about August 29, 2016, while employed in a medical center in Austin, the LVN engaged in the unlawful use of a drug called Phenobarbital in that she produced a specimen for a random drug screen that resulted in positive for Phenobarbital.   Unlawful possession of Phenobarbital is prohibited by Chapter 481(Controlled Substances Act) of theTexas Health & Safety Code. 

Subsequently, the LVN lacked fitness to practice nursing in that she enrolled in the Texas Peer Assistance Program for Nurses (TPAPN) after she was diagnosed with a substance use disorder. Furthermore, on or about  November   15, 2016,  she was  elected to  withdraw   from the  TPAPN  before completing the program.

Her condition could have affected her ability to recognize subtle signs, symptoms or changes in conditions, and could have affected her ability to make rational, accurate and appropriate assessments, judgments and decisions regarding patient care, thereby placing patients in potential  danger.

This is the reason why the Texas Board of Nursing discipline and suspended her license.

Any RN or LVN should never use any substance in and out of work as it may affect their performance, which may lead to further issues to the patients they are taking care of.
