The LVN admitted in an April 26 plea agreement to two counts of conspiracy to commit healthcare fraud. According to court documents, he owned and operated two clinics between Aug. 2009 and April 2016 that jointly received $17.1 million in Medicare payments for home health care services that weren’t needed or provided to their patients.

His plea agreement also indicates that he paid doctors to certify the patients and recruiters to bring Medicare qualified patients in.

However, with the failure to hire an experienced criminal nurse attorney to help her defend his side, the LVN never had the chance to defend his side of the story.

Because of this incident, the Texas Board of Nursing then subjected the LVN and his license into disciplinary action.
