Any type of accusations or criminal cases can be defended, as long as there is a skilled nurse attorney ready to assist you during the hearing before the Board of Nursing. The Texas Board of Nursing has full jurisdiction regarding cases that may affect an RN or LVN’s license from suspension, disciplinary action or revocation.
An example of this happened to an LVN in Fort Bend when she was sentenced to prison for $17.1 million in Medicare fraud.
The Fort Bend nurse was sentenced to 10 years in prison for his role in a Medicare fraud scheme that deprived the government of $17.1 million over seven years.
The 30-year old licensed vocational expressed remorse for his actions and begging the court’s mercy.” He insists he was a good nurse and made terrible, bad business mistakes.
The LVN admitted in an April 26 plea agreement to two counts of conspiracy to commit healthcare fraud. According to court documents, he owned and operated two clinics between Aug. 2009 and April 2016 that jointly received $17.1 million in Medicare payments for home health care services that weren’t needed or provided to their patients.
His plea agreement also indicates that he paid doctors to certify the patients and recruiters to bring Medicare qualified patients in.
However, with the failure to hire an experienced criminal nurse attorney to help her defend his side, the LVN never had the chance to defend his side of the story.
Because of this incident, the Texas Board of Nursing then subjected the LVN and his license into disciplinary action.
The accusation would have been defended by an experienced and skilled nurse attorney, had the LVN hired one. Hiring a nurse attorney for defense is applicable for any kind of accusation laid against an RN or LVN.
